Website use conditions and general framework for requesting and contracting enterprise services from GALA IT ATLANTIC S.L.
1. Acceptance and scope
Accessing and browsing this website implies acceptance of these use conditions. They do not replace any contract, service order, technical schedule, SLA or commercial proposal governing a specific service. A signed contractual document prevails in the event of conflict.
2. Users and business focus
The website is mainly intended for companies, carriers, professionals and institutions. Anyone requesting a proposal confirms that the information supplied is accurate and that they have sufficient authority to act for the organisation identified.
3. Commercial information
Service descriptions, maps, capacities, timelines, coverage and features are informational. No obligation to provide a service arises until feasibility is confirmed and both parties accept in writing the scope, price, taxes, term, delivery point, payment conditions and SLA.
4. Contracting process
- Receipt of the requirement and contact details.
- Technical, commercial, regulatory and feasibility assessment.
- Issue of a proposal, service order or agreement.
- Express acceptance by authorised representatives.
- Implementation, testing and acceptance under the applicable contract.
Submitting a form or email does not by itself create a contract or reserve capacity.
5. Prices, taxes and payment
Any published prices are indicative unless expressly stated otherwise. Proposals will identify currency, applicable taxes, recurring and non-recurring charges, installation costs, bank fees, due dates and review mechanisms. Tax treatment depends on customer location, service nature and current law.
6. Third-party services and routes
International services may integrate third-party networks, data centers, carriers, cloud providers, licences or infrastructure. Final selection may change due to availability, maintenance, security, compliance, performance or continuity requirements, subject to the applicable contract.
7. Acceptable use and security
Customers and users must use services lawfully and securely. Fraud, unauthorized spam, malware, attacks, infringement, unlawful access, impersonation, resource abuse and any activity contrary to law or contract are prohibited. Protective, limiting or suspension measures may be applied to protect the network, third parties or comply with legal duties.
8. Availability and service levels
Availability, response times, service credits, planned maintenance, exclusions and incident procedures are defined in the applicable SLA or service order. Unless agreed in writing, website information does not guarantee availability, latency, capacity or delivery time.
9. Intellectual property and confidentiality
Each party retains ownership of its trademarks, documentation, software, configurations and pre-existing know-how. Proposals, diagrams, prices, network designs and technical documents may be confidential and must not be disclosed or reused outside the authorised business purpose.
10. Liability
To the extent permitted by law, GALA IT ATLANTIC S.L. is not liable for damage resulting from misuse of the website, decisions based solely on general published information, customer-caused failures, force majeure or third-party services beyond its control. Specific liability limits are set in the relevant contract and do not affect non-waivable rights.
11. Data protection
Personal data is processed under the Privacy policy. Technical or commercial submissions should avoid unnecessary personal data, credentials, secrets or highly sensitive information unless an appropriate channel and agreement are in place.
12. Consumers
Where a person exceptionally contracts as a consumer, mandatory Spanish consumer law, including Royal Legislative Decree 1/2007, applies. Nothing in these conditions limits rights that cannot legally be waived.
13. Law, jurisdiction and changes
These conditions are governed by Spanish law, including Law 34/2002 and, where applicable, Law 7/1998 on general contracting conditions. For B2B relationships, unless otherwise agreed, the courts of Santa Cruz de Tenerife have jurisdiction. GALA IT ATLANTIC S.L. may update these terms and will publish the effective version date.
